U.S. to probe Japan firms over auto parts patent abuse
8:44 pm, April 30, 2017

Jiji Press WASHINGTON (Jiji Press) — The U.S. International Trade Commission said Friday it will investigate Toyota Motor Corp., Honda Motor Co. and others over alleged infringement of patents for automotive electric motors and motor parts.

A total of 25 companies are subject to the investigation, including auto parts makers Denso Corp. and Aisin Seiki Co., as well as Germany’s BMW AG.

If a patent violation is confirmed, sales of vehicles using the auto parts may become difficult in the United States.

The investigation, which follows a complaint filed in March by Intellectual Ventures II LLC of the United States, is based on Section 337 of the 1930 Tariff Act. The U.S. firm owns at least 40,000 patents and makes profits by managing and trading them.

The ITC is slated to complete the probe within 45 days.

ITC remedial orders, including sales suspension, would take effect within 60 days unless the Office of the U.S. Trade Representative disapproves them for policy reasons.

Intellectual Ventures is a private company that centers on the development and licensing of intellectual property. Intellectual Ventures is one of the top-five owners of U.S. patents, as of 2011.[1] Its business model has a focus on buying patents and aggregating them into a large patent portfolio and licensing these patents to third parties.
In 2009, Intellectual Ventures launched a prototyping and research laboratory called Intellectual Ventures Lab[2] which attracted media controversy when the book SuperFreakonomics described its ideas for reducing global climate change. Intellectual Ventures also collaborates on humanitarian projects through its Global Good program.[3]

In 2000, Intellectual Ventures was founded as a private partnership by Nathan Myhrvold and Edward Jung of Microsoft, later joined by co-founders Peter Detkin of Intel, and Gregory Gorder of Perkins Coie. The Intellectual Ventures Management Company is owned 40% Nathan Myhrvold, 20% Peter Detkin, 20% Gregory Gorder and 20% Edward Jung. They reportedly have raised over $5.5 billion from many large companies including Microsoft, Intel, Sony, Nokia, Apple, Google, Yahoo, American Express, Adobe, SAP, Nvidia, and eBay, plus investment firms such as Stanford, Hewlett Foundation, Mayo Clinic, and Charles River Ventures.[4] In December 2013, Intellectual Ventures released a list of approximately 33,000 of the nearly 40,000 assets in their monetization program.[5][6] Licenses to patents are obtained through investment and royalties.[7] In March 2009, Intellectual Ventures announced expansion into China, India, Japan, Korea and Singapore to build partnerships with prominent scientists and institutions in Asia to create and market inventions.

Perkins Coie is an international law firm headquartered in Seattle, Washington and is the oldest and largest law firm headquartered in the Pacific Northwest and has a total of 19 offices across the United States and Asia.
Additionally, Chambers regularly ranks Perkins Coie's Political Law practice first in the United States.[2] The firm is counsel of record for the Democratic National Committee, and other political clients include nearly all Democratic members of the United States Congress, as well as several presidential campaigns, including those of John Kerry and Barack Obama. In 2009, President Obama appointed Robert Bauer, the chair of the firm's Political Law practice, to become his White House Counsel. Bauer returned to private practice with Perkins Coie in 2011. In 2015, Hillary Clinton named Marc Elias as general counsel to her campaign.[3]Living alumni of the firm include the 16th Lieutenant Governor of Washington Cyrus Habib, former Attorney General of Washington State Rob McKenna, 9th Circuit Court of Appeals Judges Margaret McKeown and Ronald M. Gould, and Oregon State Representative Chris Garrett.
The firm was founded in 1912 and has represented the Boeing Company since the founding of the aerospace company in 1916. Other clients include Microsoft, Amazon.com, Starbucks, Costco, Craigslist, Google, Facebook, Intel, Twitter, AT&T, Zillow, REI, Intellectual Ventures, UPS, Barack Obama, Expedia, Safeco, T-Mobile, Dale Chihuly, Quora and Nintendo.
Perkins Coie also serves as counsel of record for the Democratic Party and its candidates; its political law group was for many years headed by campaign lawyer Bob Bauer,[4] and is now chaired by Marc Elias.[3] Perkins Coie represented John Kerry's presidential campaign and the Presidential campaign of Barack Obama, and continues to represent President Obama. The firm represented Christine Gregoire in the prolonged litigation surrounding her 2004 Washington gubernatorial election, and a team of Perkins lawyers headed by Marc Elias successfully represented Al Franken in his legal battle over the 2008 Senatorial election in Minnesota.[5] The firm also represents the Democratic Leadership Council, the Democratic Senatorial Campaign Committee and the Democratic Congressional Campaign Committee.
In 2006, Perkins Coie, led by partner Harry Schneider, represented Salim Ahmed Hamdan, the alleged driver and bodyguard of Osama Bin Laden. The case made its way to the U.S. Supreme Court in Hamdan v. Rumsfeld,[6] in which the Court ruled that the Bush Administration's use of military commissions to try terrorism suspects was unconstitutional.[7]Perkins worked in the Doe v. Reed case concerning petition signatures in state ballot initiative campaigns, which was argued successfully before the U.S. Supreme Court on April 28, 2010.[8]
