ゴーン容疑者、藍綬褒章剥奪の可能性 日産激震！ゴーン会長逮捕

東京地検特捜部に逮捕された、日産自動車会長のゴーン容疑者は２００４年春、産業振興などの公共活動に貢献した人に贈られる「藍綬褒章（らんじゅほうしょう）」を受章していた。罪が確定すれば、褒章が剥奪される可能性が出てきた。
ゴーン容疑者は当時、皇居・宮殿で天皇陛下に拝謁し、日本語で「私どもの栄誉、これにすぐるものはございません」と、外国人で初めて受章者代表であいさつしたが、状況は一変した。
受章者が罪を犯すと、明治４１年に勅令として出された「勲章褫（ち）奪令」という政令に抵触する。「褫奪」は「取り上げること」を意味する古い言葉だ。第１条に「勲章を有する者が死刑、懲役、無期、３年以上の禁錮刑に処せられると、その勲章は取り上げられる」と明記されている。
ゴーン容疑者は金融商品取引法違反（有価証券報告書への虚偽記載）容疑で逮捕された。その罪は「１０年以下の懲役か１千万円以下の罰金、またはその両方」で、勲章褫奪令に引っかかる。
司法当局が今後、会社法の特別背任罪（法定刑は「１０年以下の懲役又は１千万円以下の罰金」）にもあたると判断すれば、褒章が剥奪される可能性はさらに強まる。
